Key technologies for certain technical standard or specific industry need to establish a patent pool or a patent alliance for different purposes to promote package licensing of standard essential patent, jointly prevent patent risk in the industry, or promote collaborative innovation of common key technologies in the industry. However, before specific establishment, it is necessary to consider how to design the patent pool/patent alliance’s positioning, structure, standard of patent convening, evaluation principle, and patent holder’s rights and obligations, etc.

Working procedure

When conducting establishment of a patent pool or patent alliance, IPFuTure usually follows the work flow below:

  To build the patent pool for standard essential patents, including determining independent assessment principles and appraisers, issuing patent convening announcement to potential patent holders, conducting necessity assessment, drafting pooling agreement and organizing patent holders to sign, organizing patent holders to discuss and determine the patent pool permission conditions, and conducting permission and operation of patent pool as the operation agency commissioned by patent holders, etc.;

  To design patent alliance’s positioning and structure, organize the alliance initiators to negotiate and confirm alliance patent policy, and draft alliance member agreement for patent alliance;

  To design the evaluation principle of patent pooling, and take responsibility for submitting the assessment of pooling patents for patent alliance that needs to establish a patent pool;

  To solve patent problems in patent alliance operation such as screening and assessment of defensive acquisition patents, design of responding strategy, and the management of industrial litigation cases, etc.
